These Terms of Service ("Terms") govern your access to and use of the Disparity application and related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Service.

2. Description of the Service

Disparity is a software platform designed to help users explore artificial intelligence tools, workflows, prompts, and automation resources.

The Service may include:

  • AI-powered tools

  • prompt generation

  • workflows and saved content

  • educational and productivity features

  • subscription-based functionality

Features may change, evolve, or be removed at any time.

3. Eligibility

You must comply with all applicable laws when using the Service.

By using Disparity, you represent that:

  • you are legally able to enter into binding agreements in your jurisdiction

  • you will use the Service only for lawful purposes

  • you will comply with these Terms

4. User Accounts

To access certain features, you may be required to create an account.

You are responsible for:

  • maintaining the security of your account

  • all activity under your account

  • providing accurate account information

We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Content

Users may submit, create, or store content within the Service, including:

  • prompts

  • messages

  • workflows

  • generated outputs

  • saved tools

You retain ownership of your content.

However, by submitting content to Disparity, you grant the Company a limited license to:

  • store the content

  • process the content

  • display the content

  • operate and improve the Service

This license exists only for the purpose of providing the Service.

6. AI Generated Content

Disparity includes features that generate content using artificial intelligence.

AI-generated content:

  • may be inaccurate

  • may contain errors

  • should not be relied upon as professional advice

Users are responsible for evaluating and verifying AI outputs.

The Company is not responsible for decisions made based on generated content.

7. Acceptable Use

You agree not to use the Service to:

  • violate any law or regulation

  • infringe intellectual property rights

  • distribute harmful or illegal content

  • attempt to access systems without authorization

  • interfere with the operation of the Service

  • reverse engineer or copy the platform

We reserve the right to remove content or suspend accounts that violate these rules.

8. Subscriptions and Payments

Certain features of Disparity may require a paid subscription.

Subscriptions are processed through Apple In-App Purchases.

Apple manages:

  • billing

  • payment processing

  • subscription renewals

Subscriptions automatically renew unless canceled through your Apple account settings.

Refund requests must be handled through Apple.

9. Intellectual Property

All rights, title, and interest in the Service remain the property of FWD CO.

This includes:

  • software

  • platform architecture

  • design

  • trademarks

  • databases

  • intellectual property

Users receive a limited, non-exclusive, revocable license to use the Service in accordance with these Terms.

No ownership rights are transferred.

10. Service Availability

We strive to keep the Service available and reliable.

However, the Service may experience:

  • downtime

  • interruptions

  • feature changes

  • maintenance periods

We do not guarantee uninterrupted availability.

11. Termination

We may suspend or terminate access to the Service if:

  • these Terms are violated

  • misuse or abuse is detected

  • required by law

Users may stop using the Service at any time and may delete their account within the application.

12. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

  • indirect damages

  • loss of data

  • loss of profits

  • business interruptions

  • reliance on AI-generated content

The Service is provided "as is" without warranties of any kind.

13. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or liabilities arising from:

  • misuse of the Service

  • violation of these Terms

  • violation of third-party rights

14. Governing Law

These Terms shall be governed by the laws of Brazil, without regard to conflict of law principles.

Any disputes arising from these Terms shall be resolved under Brazilian jurisdiction.

15. Changes to These Terms

We may update these Terms periodically.

When changes occur, the updated version will be published with a revised "Last Updated" date.

Continued use of the Service after updates constitutes acceptance of the revised Terms.
